The establishment drops the ball over and over when it comes to cyclists getting killed....This one is in my neck of the woods and I've probably ridden that stretch of road countless times...

"Outside the courtroom, McMahon said she had the impression (justice of the peace) Quinn had "thrown up his hands" because he didn't know what sanctions he could impose to deter Dougan's conduct."
Jail time would deter his conduct. Or at least defer it.

That's our justice system. The guy had previously driven on a suspended license, so why not suspend his license as a punishment. That reminds of of someone I know who had gotten 50 hours of community service for a drug offense. He refused to do the community service and when he went back to court, the judge penalized him by sentencing him to 100 hours of community service. You can guess how many hours he did (none) and what the consequences of that were (also none).
I hope the widow wins a big settlement in a wrongful death suit.

Sometimes the prosecutor won't risk bringing more serious charges for fear of losing. Their hands could be tied by the law at the time.

The culture of weak laws governing car and truck drivers is the problem, along with poor training.
I've ridden the road that cop was killed on, it's wide and has hundreds of guys training on it every weekend.
There will not be a lawsuit, neither the driver nor the trucking company have any money. Besides, is money supposed to make it better? You think his wife will be happy with $?

Unbelieveable (not really, I guess) and it was a police officer that died. I was astounded locally in Murray when a conviction of a student for DUI/leaving the scene/vehicular homicide death of a pedestrian yielded a 20 year sentence with minimum of 17 yrs being served before parole eligibility. He was also the son of a powerful state legislator.
Does Canadian statute allow for the addition of aggravating factors (DUI, leaving the scene in my local reference) to enhance the sentencing options?

The judge is just following the laws, this is the most he could do. Judges just can't arbitrarily send someone to prison. The laws are bad in Ontario, and we have mentally ******** people driving trucks. It's too easy to get a license, it's too hard to lose a license. This guy should not have been on the road, but there is really no way to stop him.

A drivers license is viewed as a birthright - that is the problem. If we treated licensing the use of a 2 ton potential killing machine the way we treat licensing the use of a gun, the roads would become safer overnight.
Currently, no one fears losing their drivers license, thus, the last thing too many people do in their cars is focus on driving.

Why is everyone harping on the license suspension?
His track record made it clear he'll keep driving, whenever he likes, whether he has a license or not.
And his "trial" has shown us there is nothing anyone can do to stop him. He wins.
See you out there on the road, Mr. Dougan.

There have been deaths every week this summer from transport truck drivers, many have fled the scene. The problem is that most truckers have moved to Alberta to work, leaving behind basically otherwise unemployable people -so what do we do? give them a 12 tonne truck and set them lose at 120km/h on highways, I mean, what could happen? No one could foresee this. unforseeable.

I wonder if this guy can drive anywhere in that county without the cops recognizing him.

Eh, that may be true there, but the person I'm referring two got 3 strikes including 2 felonies and still hasn't served a day in prison. The judges are lenient at best when they reduce a felony to a misdemeanor and let the guy off with probation that he breaks anyway.

Part of the problem is that legal systems are over-taxed due to non-violent drug offenses being more hotly prosecuted. Which would you rather have, a guy in jail who sits in his house and smokes pot all day, or a guy driving a truck committing potentially lethal driving infractions who drives even when he's told not to?
Our sh1t is so backwards.

Maybe his community service will include cleaning the side of the highway, during which he'll get clipped by a truck load of new bikes. A55hole.
